In his communication of Tuesday, 8 September 2020, the Federal Data Protection and Information Commissioner (FDPIC) reports that the reference in the list of states (https://www.newsd.admin.ch/newsd/message/attachments/62783.pdf) of “adequate data protection under certain conditions” will be deleted for the USA, based on the Federal Data Protection Act (DSG).
This update took place against the background of the annual review of the Swiss-US Privacy Shield and the ruling of the EU Court of Justice (ECJ) in mid-July: Rechtssache C-311/18 – Data Protection Commissioner vs. Facebook Ireland Ltd and Maximillian Schrems (Schrems II) und EU-US-Privacy Shield vom EUGH gekippt.
