The New Data Protection Act Is Here: It Is Getting Serious!
The new Swiss Data Protection Act has been in force since 1 September 2023, without a transition period. We will show you the most important takeaways once again.
Our clients include domestic and foreign companies and executives in all areas of individual and collective employment law. As a highly specialised team, we prepare a thorough analysis of the facts of the case and, based on this, develop an individual and result-oriented case strategy. We are confident negotiators with a deep understanding of business, with an entrepreneurial mind-set and are always in close personal contact with our clients.
We draft individualised employment contracts and model contracts for the employees of many companies. We draw up remuneration models such as bonus agreements or employee participation models for start-ups, arrangements for flexible working hours, home office agreements, bring-your-own-device contracts or company car provision contracts.
If a company or part of a company has to be closed or relocated, we develop strategies for the practical implementation of employment law. If necessary, we supervise downsizing or relocation of employees and, if necessary, prepare mass dismissal notifications for the Federal Employment Agency.
We advise on the purchase of companies or company assets by preparing due diligence reports under employment and collective bargaining law and drafting contractual clauses for the employment law aspects of company purchase agreements.
One of our core competencies is the representation of our clients throughout Germany before the employment tribunals, regional employment courts and the Federal Employment Court in all court proceedings, in particular in dismissal protection litigation, actions for termination of employment and compensation and anti-discrimination litigation.
One main focus of our activities is the representation of temporary employment agencies in the field of temporary employment and personnel placement. In particular, we apply for AÜG (employment leasing agreements) permits, draft temporary employment contracts with hirers or employment contracts for temporary workers and assert our clients’ claims in court.
In the context of issues relating to works constitution law, we draft works agreements, conduct negotiations with the works council and represent employers in the arbitration proceedings.
We regularly advise HR departments on a variety of employment law issues such as on- and off-boarding of employees, drafting of contracts, preparation and implementation of dismissals and warnings, introduction of new processes such as working time accounts, monitoring measures of the workforce or compliance issues.
We advise and negotiate the contractual arrangements for the employment of board members and managing directors, but also in severance situations, or the processing of such contracts through termination agreements.
We advise users on all questions concerning the artists’ social security fund.
When relocating or merging operating units, we support their legal implementation.
