Good process management begins with trying to avoid going to court. Our experience enables us to assess the risk of litigation and to make both a legally and economically sound recommendation on how to proceed; should the case be taken to court, avoided or should we seek to reach a settlement?
Conduct of the case
Court proceedings require experience and specialist knowledge in the field of procedural law. An essential factor for the success of a trial is the skilful preparation of the facts of the case for the court. We do this in close cooperation with our clients, whose particular business and branch we are familiar with and understand. Of course, we also keep an eye on the tactical and formal procedural issues accompanying the process and make full use of the procedural possibilities available.
Since the founding our practice, we have successfully conducted many court cases, in particular in the areas of IP-, IT- and data protection law. In these areas we can draw on our specialist colleagues in substantive law.
Alternative Dispute Resolution (ADR)
We will also assist and support you in arbitration proceedings in accordance with the usual rules of procedure, and will be happy to assist you in any other matters. The equally applies to mediation and/or conciliation proceedings.
We have an international network of outstanding procedural lawyers whom we can consult on cross-border issues and whom we can call in or recommend as representatives when enforcing rights abroad.
Cooperation with an IT insurance company
We advise and represent an international IT insurance company and its policyholders in all matters relating to IT law and help them to defend and assert their claims in Germany.
Representation of a large research association
We are proud to advise and represent one of the largest research associations in Germany, both in and out of court, on all IP law issues.
For our clients’ events, we apply for emission permits, special use permits or event-specific building permits and win these in court or defend our clients against objections from their neighbours.
Failed IT projects
We regularly handle extensive and technically-demanding disputes involving failed IT projects. We have a thorough knowledge of the reasons for failure and the legal hurdles to enforce claims against the contractual partner, both on the client and the contractor side.
