Within the scope of the supervisory authority’s competence over collecting societies, the latter is entitled to examine whether the collecting societies operate the recovery according to fixed rules or whether the applicable tariffs are complied with.
GT 3A includes the playback of background broadcasts and music played in public areas. This does not include hotel rooms or apartments according to the Federal Administrative Court, because these are not publicly accessible and not covered by the definition of GT 3a. Therefore no fees can be claimed for such.
